TX Health Plans Issue Statement in Response to District Court Decision Ruling ACA Unconstitutional

"Every Texan should have access to affordable, comprehensive coverage"

AUSTIN—The The Texas Association of Health Plans (TAHP), the statewide trade association representing commercial and public health plans operating in Texas, today issued the following statement in response to the U.S. District Court for the Northern District of Texas' decision that found the Affordable Care Act (ACA) unconstitutional:

"The decision by the U.S District Court for the Northern District of Texas to rule the Affordable Care Act unconstitutional is an unfortunate step backward for Texans and the country,” said TAHP CEO Jamie Dudensing. "The provisions of the ACA protecting Texans should remain law regardless of what the court ruled on the individual mandate.

"This ruling is just the first step of a lengthy legal process, and it is important for Texans to understand that nothing is changing at this time. If the ruling does stand, however, it would threaten the health coverage of millions of Texans—including many with chronic and pre-existing conditions—unless Congress or the Texas Legislature intervene. 

"Every Texan should have access to affordable, comprehensive coverage regardless of their income, health status or any pre-existing condition. The Texas Association of Health Plans and its member health insurance providers are looking forward to working with the Texas Legislature, Gov. Greg Abbott and members of the Texas congressional delegation in D.C. to ensure all Texans are protected and have access to affordable health coverage.”
